Privacy Guide – TickX


  1. Introduction:

As a client of TickX, you will be controller of personal data which is processed using the TickX products, including any customer personal data processed using the TickX products.

As controller, it is your responsibility to ensure that you maintain compliant data protection processes and documents, including a compliant privacy policy/notice, in relation to all such personal data.

This document is a guide to you to inform you of some of the basic steps you should take to ensure that you maintain compliance when using the TickX products. Data protection is specific to the facts and circumstances of each individual client, and so this is for general guidance only. This guidance does not constitute legal advice, and you are responsible for your own data protection compliance. You should obtain your own legal advice.

 

  1. Privacy Policy:

You should ensure that you maintain a privacy policy, which you present to all individuals whose personal data you collect or obtain, including through the TickX Products.

Your privacy policy must cover all of your personal data processing activities, including through TickX products and otherwise.

To provide some guidance on points which are specific to the TickX products, we have set out below a number of the key points which your privacy policy should include.

     (a) Personal Data collected

The personal data collected using the TickX product will vary depending on which TickX product you are using, and the functionality you use from each. The below sets out a summary of the personal data which may be collected using different TickX products.

     Flows:
Name, Email, Phone Number, Billing Address (Address Line, City, Region, Country, ZIP / Post Code), IP Address, Marketing Cookies, UTM Parameters and Device Information.

     IQ:
IP Address, Marketing Cookies, UTM Parameters, Device Information. 

Additionally, if cart abandonment enabled: First name, Last name, and Email.

     Sign Ups and Surveys:
Name, Email, Phone Number, IP Address, Marketing Cookies, UTM Parameters and Device Information.

     PostRev:
Name, Email, Phone Number, Billing Address (Address Line, City, Region, Country, ZIP / Post Code), IP Address, Marketing Cookies, UTM Parameters and Device Information.

 

     (b) How the Personal Data is used by you

You need to clearly inform individuals of what specifically you intend to use their personal data for. You should list each individual use you wish to make of the personal data (whether done through a TickX product or otherwise).

The below sets out a summary of the functionality of each of the TickX products which you may choose to utilise to make different uses of the personal data.

     Flows, IQ and PostRev:

  • Traffic, Order & Customer Analytics
  • Marketing Attribution
  • Cart Abandonment
  • Marketing Audiences
  • Integrations with CRM systems
  • Automated transactional messaging
  • Server-side conversion tracking

     Sign Ups and Surveys:

  • Survey Analytics
  • Marketing Audiences
  • Integrations with CRM systems
  • Automated transactional messaging

 

     (c) The legal basis on which you make use of the Personal Data

You need to look at each use you make of the personal data, and make an assessment of the appropriate legal basis on which you rely in order to make use of that personal data.

The most common bases on which our clients relay (however there are six legal bases in total) are either:

     i) that you have the individual’s consent;

     ii) that it is necessary for your legitimate interests or those of a third party, except where those interests are overridden by the interests or fundamental rights and freedoms of the individual; and

     iii) that it is necessary in order to perform your contract with the individual.

Often our clients use different legal bases for different uses they make of the personal data. You will need to carry out an assessment of each use and decide which legal basis is the most applicable to you, and whether you are entitled to rely on it. For example, if you believe legitimate interests is the appropriate basis, you must document this decision in a legitimate interests assessment.

 

     (d) Third parties who you share the Personal Data with

You need to clearly set out the details of any third parties with whom you share the personal data, which includes TickX.

When using Flows, Sign Ups and Surveys, or PostRev, limited personal data (IP Address, Cookies and Device Information) is also shared with our monitoring and alerting providers, Amplitude & Sentry.

 

  1. Template Privacy Policy Wording:

You should take your own independent legal advice on the contents of your Privacy Policy, however we have set out below short template wording that you may wish to use in order to inform your Privacy Policy in relation to each of the sections set out in Part 2 above. This is not exhaustive and is only a small section of what is required in your Privacy Policy.

     (a) Personal Data collected

We may collect, process and use the following information that you provide when you sign up for, or purchase, or abandon the purchase of, tickets for events:

  • name;
  • address;
  • email address;
  • telephone number;
  • your payment card information;
  • cookies;
  • marketing source;
  • ip address; and
  • device information.

 

     (b) How the Personal Data is used by you and your legal basis for doing so

We process your personal data in the following ways, and for the following purposes:

  • to deliver any tickets or other products purchased by you, [we do this on the bases that it is necessary in order to perform our contract with you, and that it is in our legitimate interest to do so];
  • for the purposes of sending you direct electronic marketing, [we do this on the basis that we have your consent OR we do this on the basis that it is in our legitimate interest to do so, that we collected your personal data in the course of making or negotiating a sale, and that you did not opt-out of receiving such direct marketing];
  • to send you confirmation emails or text messages, to verify and confirm your contact details, to update you on important information related to your booking and to send other transactional messaging, [we do this on the basis that it is necessary in order to perform our contract with you OR that it is in our legitimate interest to do so];
  • to improve our service and products, including through measuring traffic, order and customer analytics, cart abandonment, and automated server-side conversion tracking, [we do this on the basis that it is necessary in order to perform our contract with you OR that it is in our legitimate interest to do so];
  • to inform our future marketing that we send to you and to personalise your user experience in the future, including through marketing attribution, creating marketing audiences and integrating with CRM systems, [we do this on the basis that it is in our legitimate interest to do so]; and
  • any other purposes where we have obtained your consent to do so, [we do this on the basis that we have your consent].

 

     (c) Third parties who you share the Personal Data with

We may share your personal data with selected third parties in the following circumstances:

  • we may use technology providers in order to process orders for tickets and inform and process our direct electronic marketing, which includes TickX; and
  • we may use technology providers in order to understand website interaction behaviour and monitor errors, which includes Amplitude and Sentry; and
